Design application in Mexico The design patent in Mexico is valid for 5 years from the date of application. It can be renewed in advance upon expiration, and each renewal can be extended for 5 years, with a maximum protection period of 25 years. The deadline for submitting a renewal application is 6 months before the expiration date. If the renewal is overdue, a 6-month grace period will begin. If the renewal is not made within the grace period, the design patent will become invalid. Application Materials 1. Applicant’s name and address in Chinese and English 2. Information related to the appearance design (product name, product purpose) 3. Inventor’s name and address in Chinese and English 4. Six-sided view + stereogram (each view in jpg format) 5. Priority information is required if priority is claimed 6. Scanned copy of the power of attorney Application Process The date on which MPI receives the design registration application will be deemed as the filing date. After receiving the application, MPI will conduct a formal review of the application materials. If the formal review finds that the materials are missing or insufficient, a notice of correction will be issued. The applicant is required to provide necessary explanation, elaboration or supplement the missing content within 2 months. If the applicant fails to provide explanations or supplements within the prescribed period and meet legal requirements, the design registration application will be deemed abandoned. The validity period for issuing a receipt is 1 week, and the validity period for registration is 16-18 months. For design registration applications that pass the review, the Mexican Patent Office will publish them and send the applicant a notice of approval of registration. The applicant must pay the authorization fee and the annual maintenance fee for the first 5 years within 2 months of receiving the approval authorization notice.
